1. Acceptance of Terms

By accessing or using this website, or by requesting services from Santa Barbara Sunrooms & Patios, you agree to be bound by these terms and conditions. If you do not agree, please do not use this website or request our services. These terms apply to all visitors, users, and anyone who contacts us through this site.

2. Description of Services

Santa Barbara Sunrooms & Patios is a sunroom and patio contractor based in Santa Barbara, CA. We provide sunroom additions, patio enclosures, four-season and three-season sunrooms, screen room installation, solarium installation, patio cover installation, sunroom remodeling, and related design and construction services. All services are provided subject to a separate written contract executed between Santa Barbara Sunrooms & Patios and the customer prior to the start of any work.

3. Estimates and Pricing

Any estimate or quote provided by Santa Barbara Sunrooms & Patios - whether by phone, email, form submission, or in person - is an estimate only and is not a binding contract. A project price becomes binding only when both parties have signed a written contract for that specific project.

Estimates are based on information available at the time of preparation. Final pricing may vary from an estimate if:

• The scope of work changes at the customer's request.
• Unforeseen site conditions are discovered during construction, such as existing structural deficiencies, hidden utility lines, or code compliance issues in existing structures.
• Material costs change significantly between the date of the estimate and the date of construction.

Any change that affects the contract price will be documented in a written change order signed by both parties before work proceeds.

4. Scheduling and Cancellation

Project start dates are estimates subject to permit approval timelines, weather, and contractor availability. Santa Barbara Sunrooms & Patios will communicate scheduling updates in a timely manner.

If a customer wishes to cancel a signed contract, the following applies:

• Cancellation requests must be submitted in writing to team@santabarbarasunroomcontractor.com.
• Any costs already incurred - including permit fees, materials ordered, or work completed - will be due and payable at the time of cancellation.
• Cancellation terms specific to each project will be stated in the written contract.

Santa Barbara Sunrooms & Patios reserves the right to reschedule work due to weather conditions, permit delays, or other factors outside our reasonable control.

5. Payment Terms

Payment schedules and accepted payment methods will be specified in each written project contract. Generally, projects require a deposit at contract signing, progress payments tied to construction milestones, and a final payment upon completion. No work will begin until the deposit has been received.

Any invoice not paid within the time period stated in the project contract may be subject to a late fee. If payment is not received after reasonable notice, Santa Barbara Sunrooms & Patios reserves the right to suspend or cease work until the outstanding balance is resolved. The customer remains responsible for all costs incurred up to the point work is suspended.

6. Permits and Compliance

Santa Barbara Sunrooms & Patios will apply for and manage required building permits for each project as described in the written contract. The customer is responsible for disclosing any known HOA rules, easements, setback restrictions, or other property-specific conditions that may affect permitting or construction. Delays or additional costs caused by undisclosed conditions are the responsibility of the customer.

7. Limitation of Liability

To the fullest extent permitted by law, Santa Barbara Sunrooms & Patios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to any services performed or not performed, or any use of or inability to use this website, even if advised of the possibility of such damages.

Our total liability to any customer for any claim arising out of or related to a specific project shall not exceed the total amount paid by that customer for that project. This limitation applies regardless of the form of the claim - whether in contract, tort, or otherwise.

8. Warranty Disclaimer

Workmanship warranties, if any, will be stated expressly in the written project contract. Except as stated in a signed contract, all services are provided on an "as is" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Manufacturer warranties on materials, glass, or prefabricated components are subject to the terms of the manufacturer and are not an obligation of Santa Barbara Sunrooms & Patios. We will assist customers in understanding and submitting manufacturer warranty claims where applicable.

9. Intellectual Property

All content on this website - including text, images, logos, and design - is the property of Santa Barbara Sunrooms & Patios or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this site without our prior written permission.

10. Dispute Resolution

We prefer to resolve any disagreements directly and in good faith. If you have a concern about a project or this website, please contact us first at team@santabarbarasunroomcontractor.com so we have an opportunity to address it.

If a dispute cannot be resolved through direct communication, the parties agree to attempt mediation before initiating any formal legal proceedings. Any dispute that proceeds to formal resolution shall be handled in accordance with the governing law stated below.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under or related to these terms shall be brought in the appropriate courts located in Santa Barbara, California.

12. Modifications to These Terms

We reserve the right to update these terms and conditions at any time. When we do, we will revise the effective date at the top of this page. Your continued use of this website after any changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
